Eleven Years On, Qahtan’s Disappearance Underscores Accountability Failure

Women Journalists Without Chains condemns the ongoing enforced disappearance of Yemeni politician Mohammed Qahtan, describing it as a continuous and grave violation that underscores a profound failure in the enforcement of international law and accountability mechanisms.

For more than eleven years, Qahtan has remained forcibly disappeared following his abduction by the Houthi militia in April 2015. Despite the clarity of his legal status and his repeated inclusion in binding international resolutions and formal negotiation frameworks, his fate and whereabouts remain undisclosed. The organization considers this case one of the most protracted and severe instances of enforced disappearance in Yemen.

Women Journalists Without Chains affirms that Qahtan’s continued incommunicado detention—without acknowledgment of his fate or access to information regarding his condition—constitutes an ongoing crime of enforced disappearance under international law. Such violations are not subject to statutes of limitation and may rise to the level of crimes against humanity when committed as part of a systematic practice.

The organization stresses that the persistent denial of information and contact is not merely a violation of fundamental rights, but reflects a deliberate policy aimed at erasing the victim’s legal existence and obstructing accountability. This conduct represents a compounded breach of both international human rights law and international humanitarian law, particularly the non-derogable prohibition of enforced disappearance.

Women Journalists Without Chains emphasizes that this case illustrates a broader pattern of targeting political opponents and constricting civic space. Qahtan, a prominent advocate of dialogue and peaceful political engagement, was forcibly disappeared in a context that suggests a systematic effort to silence influential voices outside any legal framework.

The organization expresses grave concern over the instrumentalization of Qahtan’s case as a political bargaining tool. Over the years, his continued detention has been leveraged within negotiation processes, exacerbating the suffering of his family and compounding the violation through the deliberate withholding of truth.

Women Journalists Without Chains notes that the inclusion of Qahtan’s name in the prisoner-exchange agreement concluded in Muscat in December 2025 constituted a clear and binding commitment to resolve his case. However, the failure to implement this agreement—coupled with ongoing delays and ambiguity—reflects a serious breach of obligations and an attempt to subordinate legal duties to shifting political considerations.

The organization warns that maintaining ambiguity surrounding Qahtan’s fate, despite explicit legal commitments, effectively empties humanitarian agreements of their substance and undermines confidence in ongoing mediation efforts, perpetuating the violation rather than bringing it to an end.

Women Journalists Without Chains further recalls that United Nations Security Council Resolution 2216 (2015) explicitly calls for the immediate and unconditional release of all detainees, including Mohammed Qahtan. The continued failure to enforce this obligation for over a decade represents not only negligence, but a structural failure in the international system’s capacity to uphold its own legal standards.

The organization cautions that sustained international inaction risks normalizing enforced disappearance as a negotiable issue, thereby entrenching impunity and weakening the credibility of international justice mechanisms.

Calls for Action

Women Journalists Without Chains calls on the United Nations, the Office of the Special Envoy for Yemen, and the International Committee of the Red Cross to take urgent and concrete measures to:
* Ensure the immediate disclosure of Mohammed Qahtan’s fate and whereabouts;
* Secure his unconditional release as a non-negotiable legal obligation;
* Guarantee the full and transparent implementation of the December 2025 prisoner-exchange agreement, without political obstruction or delay.

Conclusion

Women Journalists Without Chains underscores that the prolonged disappearance of Mohammed Qahtan stands as a stark indicator of the international community’s inability to enforce its own resolutions. Failure to ensure accountability in this case not only undermines the credibility of international law, but also erodes the foundations of justice and the rule of law. Sustainable peace in Yemen remains unattainable without genuine accountability and a decisive end to impunity.
